Nous avons pris connaissance de la condamnation du cacique Marcos Luidson de Araújo et de 30 indigènes Xukuru en raison des incidents qui ont eu lieu le 7 février 2003, à Vila Cimbres dans le territoire Xukuru, situé dans la municipalité de Pesqueira, état de Pernambuco, et cela nous préoccupe grandement.
Le peuple Xukuru et ses chefs, comme le cacique Marcos et son père le cacique Xicao, sont connus nationalement et internationalement pour la lutte infatigable pour la démarcation de leur territoire traditionnel et pour leur respect des organisations sociales des peuples indigènes. Tous les deux ont toujours agi pour la défense des droits humains et la reconnaissance d´un Etat pluriethnique et multiculturel, motif pour lequel le cacique Xicao a été assassiné en 1988.
L´analyse du procès qui a abouti aux 31 condamnations met en évidence des irrégularités, vu que d´importants éléments de preuves n´ont pas été analysés en soi ni dans le contexte, c´est à dire le projet de fortifier le peuple Xukuru.
Tout particulièrement, durant le procès, il n’a pas été tenu compte du fait que c´est l´assassinat de 2 jeunes indigènes et la tentative d´assassiner le cacique Marcos, au matin de ce jour là, qui ont engendré la réaction de la communauté Xukuru dans son ensemble.
En plus de cela, des preuves importantes qui pourraient conduire à d´autres types de décisions n´ont pas été dûment analysées. Et nous déplorons que presque tous les témoins de l´accusation puissent être considérés comme des ennemis du projet de fortification du peuple Xukuru.
Par la présente nous vous demandons de bien vouloir reconsidérer la condamnation en tenant compte des éléments non pris en compte. Nous faisons confiance au Pouvoir Judiciaire Brésilien et espérons que JUSTICE soit faite.

Tomamos conhecimento que o cacique Marcos Luidson de Araújo e outros 30 indígenas Xukuru foram condenados em virtude de incidentes ocorridos no dia 7 de fevereiro de 2003, na Vila de Cimbres, dentro da terra Xukuru, no município de Pesqueira (PE), o que nos deixou bastante preocupados.
O povo Xukuru e suas lideranças, como o cacique Marcos e seu pai, o cacique Chicão Xukuru, são reconhecidos nacional e internacionalmente pela luta incansável pela recuperação de seu território tradicional e pelo respeito à organização social dos povos indígenas. Ambos sempre atuaram em defesa dos direitos humanos e do reconhecimento de um Estado pluriétnico e multicultural, motivo pelo qual o cacique Chicão foi assassinado em 1998.
A análise do processo que resultou nas 31 condenações evidencia haver irregularidades, uma vez que importantes fatos relativos a provas não teriam sido analisados em si mesmos e nem dentro do contexto específico em que se inserem, ou seja, o projeto de fortalecimento do povo Xukuru.
No processo, não ficou evidenciado, e devidamente sopesado, que foi o assassinato de dois jovens indígenas e a tentativa de assassinato do cacique Marcos, na manhã daquele dia, que geraram a reação da comunidade Xukuru como um todo.
Quase todas as testemunhas de acusação são consideradas inimigas do projeto de fortalecimento do povo Xukuru. Além disso, provas importantes que poderiam conduzir a outro tipo de decisão não teriam sido devidamente analisadas.
